ORDINANCE<\/span> REPEALING <\/span>MENDOCINO <\/span>COUNTY <\/span>CODE <\/span>SECTION <\/span>2.16.041,<\/span> ADDING <\/span><\/strong>
SECTION<\/span> 2.16.070 <\/span>AND <\/span>AMENDING <\/span>CHAPTER <\/span>2.36 <\/span>FOR <\/span>THE <\/span>PURPOSE <\/span>OF <\/span><\/strong>
CONSOLIDATING <\/span>THE <\/span>OFFICES <\/span>OF <\/span>THE <\/span>AUDITOR<\/span>-<\/span>CONTROLLER <\/span>AND <\/span>THE <\/span><\/strong>
TREASURER<\/span>-<\/span>TAX COLLECTOR<\/span> <\/strong><\/span><\/p>\n

<\/span>The Board of Superviso<\/span>rs of the County of Mendocino, State of California, ordains as follows:<\/span> <\/span><\/span><\/p>\n


Section 1<\/span>: <\/span> <\/strong>Section 2.16.041 is hereby repealed.<\/span> <\/span><\/span>
Section 2<\/span>:<\/span> <\/strong>Section 2.16.070 is hereby added to read as follows<\/span>:<\/span> <\/span><\/span><\/p>\n


Sec. 2.<\/span>16<\/span>.0<\/span>7<\/span>0 <\/span> \u2013<\/span> Office of County Auditor<\/span>-<\/span>Controller and County Trea<\/span>surer<\/span>-<\/span>Tax <\/span><\/strong>
Collector Consolidated<\/span>. <\/span> <\/strong><\/span>
<\/span>
Pursuant to Government Code Sections 24304.2 and 24305, the duties<\/span> and the budgets <\/span>
of the Offices of County Auditor<\/span>-<\/span>Controller and County Treasurer<\/span>-<\/span>Tax <\/span> Collector are <\/span>
hereby consolidated effective <\/span>12 o\u2019clock noon on Janua<\/span>ry 2, 2023<\/span>.<\/span> The title of the officer <\/span>
performing the duties of the offices hereby consolidated shall the \u201cCounty Auditor<\/span>-<\/span>
Controller<\/span>-<\/span>Treasurer<\/span>-<\/span>Tax Collector.\u201d<\/span> <\/span><\/p>\n

<\/span><\/span>
Section 3<\/span>:<\/span><\/strong> Chapter 2.36 is hereby amended in its entirety to read as follows:<\/span> <\/span>
<\/span>
CHAPTER 2.36 <\/span>-<\/span> CO<\/span>UNTY AUDITOR<\/span>-<\/span>CONTROLLER<\/span>-<\/span>TREASURER<\/span>-<\/span>TAX <\/span><\/strong>
COLLECTOR<\/span> <\/strong><\/span>
<\/span>
Sec. 2.36.010 <\/span>-<\/span> Qualifications for Office.<\/span> <\/span><\/strong>
<\/span>
Pursuant to the provisions of Government Code Sections 26946 and 27000.6, the <\/span>
provisions <\/span>of <\/span>Government <\/span>Code <\/span>Sections <\/span>26945 <\/span>and <\/span>27000.7 <\/span>are <\/span>hereby <\/span>made <\/span>
applicable <\/span>t<\/span>o <\/span>the <\/span>position <\/span>of <\/span>County <\/span>Auditor<\/span>-<\/span>Controller<\/span>-<\/span>Treasurer<\/span>-<\/span>Tax <\/span>Collector. <\/span>
Accordingly, to be eligible for election or appointment to the office of County Auditor<\/span>-<\/span>
Controller<\/span>-<\/span>Treasurer<\/span>-<\/span>Tax Collector, a person must possess the qualifications established <\/span>
by <\/span>State <\/span>l<\/span>aw <\/span>for <\/span>both <\/span>County <\/span>Auditor <\/span>and <\/span>County <\/span>Treasurer. <\/span>Evidence <\/span>of <\/span>such <\/span>
qualifications shall be presented to the registrar of voters with a candidate\u2019s nomination <\/span>
papers.<\/span> <\/span>
<\/span>
Sec. 2.36.010 <\/span>\u2013<\/span> Continuing Education<\/span>.<\/span> <\/strong><\/span>
<\/span>
Pursuant to the provisions of Government Code Secti<\/span>ons 26946 and 27000.6, the <\/span>
provisions <\/span>of <\/span>Government <\/span>Code <\/span>Section <\/span>26945, <\/span>concerning <\/span>continuing <\/span>education <\/span>
requirements for County Auditors, and the provisions of Government Code Sections <\/span>
27000.8 <\/span>and <\/span>27000.9, <\/span>concerning <\/span>continuing <\/span>education <\/span>requirements <\/span>for <\/span>C<\/span>ounty <\/span>
Treasurer, are hereby made applicable to the position of County Auditor<\/span>-<\/span>Controller<\/span>-<\/span>
Treasurer<\/span>-<\/span>Tax Collector.<\/span> <\/span><\/span><\/p>\n


<\/span>
Section 4<\/span>.<\/span> Severability.<\/span> <\/strong>If any section, subsection, sentence, clause, phrase or portion of <\/span>
this ordinance is for any reason held invalid or<\/span> unconstitutional by a decision of any court of <\/span>
competent jurisdiction, such decision shall not affect the validity of the remaining portions of this <\/span>
ordinance. The Board of Supervisors hereby declares that it would have passed this ordinance <\/span>
and each sec<\/span>tion, subsection, sentence, clause and phrase thereof, irrespective of the fact that <\/span>
any one or more sections, subsections, sentences, clauses or phrases be declared invalid or <\/span>
unconstitutional.<\/span> <\/span><\/p>\n

<\/span>Section <\/span>5<\/span>.<\/span> Effective Date<\/span>.<\/span><\/strong> This ordinance shall take effect<\/span> on the 31st day after the date of <\/span>
final passage, but shall become operative <\/span>12 o\u2019clock noon on January 2, 2023<\/span>.<\/span> <\/span>
